General summary of 2021’s environmental legislation
It is expected that in 2021 the management strategies of companies will be increasingly focused on technology, the reuse of waste and the circular economy. For this reason, there is a great need for the development of the PNRS guidelines on reverse logistics to become clearer to society and the private sector. In addition, it is also necessary to better clarify the way in which each of the entities in the chain should act. , for a satisfactory management of the productive chain is that the concentration of waste should no longer end up in landfills as a final destination – and this should have been resolved at least 6 years ago!
Both PLANARES and the State Plan for Solid Waste in São Paulo intend to define the strategy that already exists for waste management for the coming years. Aiming at the broader and more effective implementation of the National Solid Waste Policy. The scenario starting in 2021, for the sector, should more than ever gain strength and economic infrastructure, being the priority of the Executive Branch. Furthermore, still talking about PLANARES, it sets a goal that, starting in 2021 and continuing for the next twenty years, about 20% of the total urban solid waste is recycled and at least 80% of the population has access to a system of selective collect! This change in the solid waste sector depends on the active and direct participation of both private entities, the government and society.
Another important legislative point to remember and quote here is the end of the landfills and open air-dumps, which has been postponed year after year due to the lack of commitment from states and municipalities, and also from private sector companies. According to the new law on the basic sanitation framework, the city halls of the country have until December 31 of this year to prepare their PGRS and ensure the correct disposal of waste. This new law makes the deadlines more comprehensive for the fulfillment of goals to eliminate dumps in Brazil. Still, all capitals and metropolitan regions of the country have until August 2021 to end their waste sent for landfills and air-dumps.
Importance of being aligned with sustainable practices
Now, talking about environmental standards and practices, for some time now, companies have been concerned with their environmental footprint, and the “green culture” has been increasingly installed in large corporations. With the pandemic of the new CoronaVirus, there was a general awakening of consciousness in large parts of society, which will begin to be put into practice effectively from 2021 – even though it has already started. For 2021, ESG will be an acronym connected with the environment and with investments!
Companies that have the best environmental, social and corporate governance practices will be more valued from the point of view of potential investors, as they are contributing to a more sustainable, fair and ethical world. This change in mindset helped to create “sustainability funds”, which choose the companies in which they intend to invest, giving priority to those that are up to date with sustainability practices. Companies with high and considerable levels of governance, who seek sustainability and stand out for their social responsibility, guarantee a significant competitive differential when choosing to receive investments.
